Can I legally homeschool my special needs son who's in public school Special Ed. w/IEP even if panel objects?
8 year old clinically diagnosed with ADD, ADHD and Bi-Polar. Taken numerous medications but due to side effects or ineffectiveness medication has ceased temporarily per doctor orders. Enrolled in public school igned to Spec. Ed cl but being mainstreamed to reg. ed cl approx 1 1/2 hrs per day. Bright outgoing yet overbearing hyper child able to comprehend but academically not up to 1st grade level. Preschool, headstart and two years of kindergarten was unable to remain enrolled due to behavior, immaturity and/or recommendation of teacher, staff, and/or parent to be withdrawn.. Home schooled temporarily, Returned to school , evaluated igned IEP placed into special ed did wonderful all year. IEP end of school agree to transfer to reg ed cl with special ed resource to school closer to home with recommendation of male teacher and lots of resources avail and computer time. IEP not followed and subsequently removed from school and returns to spec ed another IEP tries to mainstream 1/2 day but ease slowly after week child readjusts and does fine. shortly there after problems arise with no communication, no accommodations, no instructions to reg ed teacher on how to handle child or situation, IEP wasn't even given to teachers so no guidelines were followed, no enforcement of them either. Numerous informal meetings and two IEPs that weren't adhered to yet no actual annual conducted. Even though teachers agree child needs aide to ist while in reg ed class the designee for school refuses, spec ed teacher offers one of her aids temporarily to accommodate child but aide only present not actually one on one. doctor later submitted letter stating he should be removed and/or half day assignment until medication/health issed could be stabilized but panel objects, Child made to compete with other students far beyond child academically and losses recess if unable to, teacher tells him he is invisible and refused to help. confronted at meeting and designee did uinform instructor he cannot do that but child now doesnt want to go because feels stupid, singled out or neglected, hates school and acts out to avoid reg class with this teacher, Numerous suggestions and meetings yet nothing implemented or enforced as a whole. set for IEP and have been informed that basically panel; will not approve aide nor remove from reg ed class wants to increase more reg ed time but with no assistance, I have to be on immediate call to pick him up causing me to have to withdraw from college and now not even enroll. Much more info thats important but so long and outlandish example CPS called three times by school for ridiculous things that made no sense but coincidentally just after ing heads over an issue. Interference of school counselor/psychologist to pediatrician suggesting for child to be put back on a medicine at a higher dose that caused him to lose an extreme amount of weight but doctor refused, Many incidents, compolaints, requests , informal meetings, suggestions etc to no avail. Need advice, thoughts, and direction
